In the first quarter of the year, over 17,000 building activities were inspected by Romanian authorities. In 25 percents of the cases, the authorities found deficiencies and ordered punitive measures, according to statistics consulted by Pavel, Margarit & Associates Romanian Law Firm.

 

From 2016 to 2018, the number of construction activities inspected by the authorities has increased. At the same time, the number of deficiencies discovered in the construction works has decreased, but very slightly.

 

In the first quarter of the year, 4,423 deficiencies were found. In the same interval in 2017, 4,680 deficiencies were detected.

 

During January-March, the authorities applied 312 sanctions, accounting EUR 500.000.

 

Nearly half of the inspections performed in the first quarter of the year were focused on construction work.

 

According to the construction specialists, most of the problems encountered in building construction were: violation of the provisions of the notices, failure to meet the obligations established by the regulations and procedures elaborated in application of the Law no. 10/1995; building construction without technical responsible technicians.

“Once the construction market has grown, the number of deficiencies has increased. Many of these controls target new real estate assemblies. As a result of the controls, more and more authorities have sued the real estate developers in order to force them to remedy the damage caused. Many times, however, we also have an excess of zeal from the authorities. Both developers and prospective tenants can use legal advice before they start a real estate project or before signing the sale – purchase contract, in order to prevent any problems that may arise. Also, when the damage occurred, there is a high chance for it to be recovered  in court”, said Radu Pavel, Managing Partner of Pavel, Margarit and Associates Romanian Law Firm.

A lawsuit initiated by a state authority for a construction litigation does not guarantee the recovery of the benefit by the injured party.
