- Romanian Order no. 78/2023 for the amendment of the Regulation on the functioning of the centralized market for electricity from renewable sources supported by green certificates, approved by the Order of the President of the National Energy Regulatory Authority no. 160/2019
- Participant in the centralized market for electricity from renewable sources supported by green certificates – licensee, natural or legal person provided in art. 3 lit. a ) -c ), which falls within this market and complies with the participation agreement of this centralized market; in the case of the participation as a single aggregate entity of several producers of electricity from renewable sources, the participant is considered to be the one they designate to trade in electricity and to which all the responsibilities and rights provided for in the Convention are fully responsible, except for the delivery of green certificates, which will be done by the centralized market operator for electricity from renewable sources supported by green certificates for each member of the aggregate entity that traded green certificates during the direct auction session from the seller’s account to the buyer’s account.
- The previously provided agreement will contain provisions that shall comply with the following principles:
a) the designated participant concludes the agreement in his own name and fully assumes all the rights and obligations regarding the traded electricity;
b) the agreement contains individual rights and obligations regarding the delivery of CVs of the members of the aggregate entity who traded CV during the auction session following which the agreement is concluded;
c) OPECV transfers CV according to the obligations provided in the agreement for each member of the aggregate entity that traded CV during the auction session;
d) non-compliance with the obligations assumed in the agreement by any of the members of the aggregate entity shall attract contractual liability of each of the members of the aggregated entity.
