The Law is to be published in the Official Gazette and then will enter into force.
In accordance with the provisions of the Law, in art. 10 of Law no. 230/2007 regarding the incorporation, organization and operation of Owners associations, published in the Official Gazette of Romania, Part I, no. 490 of 23 July 2007, as amended and supplemented, after paragraph (1) is inserted a new paragraph, paragraph (2) as follows:
“At the written request of the owner, the president and administrator of the owners’ association are obliged to issue a receipt through which to present the situation of the maintenance costs, divided into main debt and penalties, as well as the method of calculation of penalties.”
Currently, according to the current regulations, Law no. 230/2007 provides only that the owners are entitled to know all aspects of the work of the association and may require access to any document thereof, without being expressly regulated the manner in which they are granted access to such information.
According to the explanatory memorandum, the reason for adoption of this law is that that Owners associations are organized and function after a series of principles and habits. The current law of the Owners associations contains numerous provisions but not enough on protecting the owners’ rights and the obligations of both the administrator and president of the association. The motives for the modification and completion of this law starts with these issues. Meanwhile, the proposed regulation comes to support the owners, for which is given the right to request the President and the Administrator of the association, in writing, a receipt, through which to present the situation of the maintenance costs, divided into main debt and penalties, as well as the method of calculation of penalties.
