1.The Romanian Law no. 144/2022 for the amendment and supplement of the art. 34 of the Law no. 53/2003 Romanian Labor Code

  • The Romanian general register of the employees is completed and sent to the Romanian territorial labor inspectorate in order of the people employment and it includes the identification elements of the employees, date of employment, position / occupation according to the Classification of the occupations in Romania or to other normative documents, level and specialty of studies, type of individual employment agreement, salary, bonuses and their amount, period and reasons for suspension of the individual employment agreement, period of secondment and date when the individual employment agreement was terminated.
  • The Romanian general register of the employees is available online for employees / former employees, regarding the data concerning them. The right of access is limited to viewing, downloading and printing of the data, as well as to the online generation and downloading of an extract from the register.

2.The Romanian Decision no. 230/2022 regarding the exception of unconstitutionality of the provisions of the art. 14 lit. a) and of the art. 26 lit. d) of the Romanian Law no. 51/1995 on the organization and exercise of the profession of lawyer.

  • The exception of unconstitutionality is admitted and the court notes that the provisions of the art. 14 lit. a) of the Romanian Law no. 51/1995 on the organization and exercise of the profession of lawyer, regarding the indignity of the exercise of the profession by a person who is definitively convicted by a court decision to imprisonment for committing an intentional crime, likely to harm the prestige of the profession, are unconstitutional.
