- Decision no. 860/2021 regarding the rejection of the exception of unconstitutionality of the provisions of art. 3 paragraph (1) lit. e) from Romanian Government Emergency Ordinance no. 80/2013 on Romanian judicial stamp duties, in force from 28 July 2022
- Brăila Court notified the Romanian Constitutional Court with the exception of unconstitutionality of the provisions of art. 3 paragraph (1) from Romanian Government Emergency Ordinance no. 80/2013 regarding Romanian judicial stamp fees. The exception was raised in a file concerning claims, namely obliging a hospital in Romania to pay material and moral damages. ,,Actions and requests that can be evaluated in money, brought to the courts, are taxed as follows: […] e) between 50,001 lei and 250,000 lei – 2,105 lei + 2% for what exceeds 50,000 lei.
- The Romanian Court ruled as a matter of principle that free access to justice does not involve the gratuity of the judicial act, nor, implicitly, the achievement of rights through the Romanian court for free. No Romanian constitutional provision forbids the establishment of stamp duties in Romanian courts, being justified for the persons who address the Romanian judicial authorities to contribute to cover the expenses made with the act of justice.
- Law no. 242/2022 on the exchange of data between IT systems and the creation of the Romanian National Interoperability Platform, in force from July 30, 2022
- The purpose of this law is to adopt measures in Romania related to technologies, equipment, software programs and the data used by them, in order to contribute to increasing the degree of interconnection between the IT systems of Romanian authorities and Romanian public institutions and to facilitate the exchange of data between them, starting from the principles and objectives of the European Interoperability Framework.
- This Romanian law applies through voluntary participation, based on a data exchange contract, to Romanian legal entities under private law, respectively to individuals who exercise regulated liberal professions in Romania, to those who own computer systems and have data of interest to Romanian public authorities and Romanian institutions.
- This law applies to both central and local public Romanian authorities and Romanian institutions.
- Law no. 265/2022 regarding the Romanian Trade Register Office and for the modification and completion of other Romanian normative acts affecting registration in the Romanian Trade Register Office, will enter into force on November 26, 2022
- The law changes the registration procedure in the Romanian Trade Register based on the control of the registrar, as well as the way of organization and operation of Romanian National Trade Register Office. The Romanian registrar resolves the requests for registration in the Romanian Trade Register and other requests regarding registrations in the Trade Register. Violation by registrars of their duties shall attract disciplinary, civil or criminal liability, as the case may be.
- The request for registration in the Romanian Trade Register Office is resolved by the registrar, on the basis of documents, within one working day from the registration of the request.
